Information on Personal Data Processing

No.: 01614606, with its registered office at Pobřežní 370/4, 186 00 Prague 8 (the “Law Office”), as a personal data controller, processes and protects your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”), as well as in accordance with Act No. 85/1996 Coll, on the legal profession, as amended (the “Legal Profession Act”) and other applicable legal and professional regulations.
The following personal data processing policy (privacy policy) defines the individual categories of personal data processed, describes the purposes of personal data processing, specifies the retention period for personal data and the potential recipients of personal data, and lists your rights in relation to personal data protection.

What personal data do we process?

For each category of data subject, we process the following personal data:

Clients of the Law Office: identification details (name, surname, date of birth, birth identification number, identification number), contact data (address of residence, registered office, mailing address, email, telephone number, payment data) and other data provided by the data subject for the purpose of proper provision of legal services (information about the counterparty, claim, witnesses, etc.).

Applicants for employment or internship: identification details (name, surname, date of birth), contact details (address of residence, mailing address, email, telephone number), information on education, work experience and qualifications and other information contained in the CV provided.

Suppliers of goods and services: identification details (name, surname, identification number, tax identification number), contact details (registered office, address of residence, mailing address, email, telephone number, payment details), accounting details, information on services provided and other information contained in the tax documents provided.

For what purpose and on what legal basis do we process individual personal data?

Personal data may be processed by the Law Office for the following purposes and on the following legal basis:

Performance of a contract [Article 6(1)(b) of the GDPR]:

  • On the basis of an engagement agreement concluded between us or on the basis of the fulfilment of your requirements in the provision of legal services; on the basis of contracts with business partners, mainly suppliers of products and services; on the basis of your interest in employment or other form of co-operation with the Law Office.
  • Data processed for this purpose include, without limitation: identification and contact details, data provided by the data subject for the purpose of a proper provision of legal services, data on the education and qualifications of job applicants, accounting details, information on the services provided.
  • Please note that if the provision of personal data is required for the purpose of performing a contractual obligation, the data subject must provide the personal data; otherwise the contractual relationship from which the contractual obligation follows cannot be established.

Compliance with a legal obligation [Article 6 (1)(c) of the GDPR]

  • Compliance with obligations laid down by law, especially in the areas of tax, accounting, social security, legal profession and legalisation of the proceeds of crime (AML).
  • Data processed for this purpose include, without limitation: identification and contact details, data provided by the data subject for the purpose of a proper provision of legal services, data on the education and qualifications of job applicants, accounting details, information on the services provided.
  • Please note that if the provision of personal data is required in order to comply with a legal obligation, the data subject must provide the personal data; otherwise an obligation following from legal regulations may be breached.

Legitimate interest [Article 6(1)(f) of the GDPR]:

  • The controller’s legitimate interests include mainly marketing, preventing legalisation of the proceeds of crime (AML) and protection of the Law Office’s economic interests. Legitimate interests of third parties include, in particular, protection in accordance with the rules governing the performance of the legal profession.
  • Data processed for this purpose include, without limitation: identification and contact details, data provided by the data subject for the purpose of a proper provision of legal services, accounting details, information on the services provided.

Consent of the data subject [Article 6(1)(a) of the GDPR]:

  • This includes, for example, your consent given for the purpose of publishing a testimonial or sending general legal and other similar information and communications to clients and other persons who have requested or approved this. The provision of such consent is voluntary and consent may be withdrawn in writing at any time.
  • The following personal data are processed for this purpose, in particular: name, surname, identification number, registered office, mailing address, email, telephone number, general characteristics of the legal service provided.
    Personal data processing does not include any automated decision-making or profiling.

For how long do we process your personal data?

Personal data are processed for the necessary period of time, taking into account the wording of the contract concluded with the data subject and the obligations arising for the data controller from generally binding legal and professional regulations (e.g. the Legal Profession Act, Act No. 253/2008 Coll., on certain measures against legalising the proceeds of crime and financing terrorism (AML Act), Act No. 499/2004 Coll., on archives and the filing service and on amendment to certain laws).

Who may be the recipient of personal data?

Personal data may be disclosed to recipients only to the extent necessary for the fulfilment of the individual purposes of processing and on the basis of the corresponding legal ground for the processing of personal data. Possible recipients of personal data include public authorities and entities entrusted with the performance of tasks in the public interest, the Law Office’s suppliers of information systems and accounting, tax and other services relating to the provision of legal services (e.g. co-operating lawyers, experts, interpreters) and contracting authorities. All these recipients will be bound by the obligation not to further disclose the personal data and will guarantee that appropriate technical and organisational measures are in place to ensure an adequate level of security of the personal data.

What rights do you have as a data subject?

In connection with personal data processing, the data subject has the right of access to personal data relating to the data subject (Article 15 of the GDPR), the right to rectification or completion of personal data (Article 16 of the GDPR), the right to erasure – the right to be forgotten (Article 17 of the GDPR), the right to restriction of processing (Article 18 of the GDPR), the right to object to processing (Article 21(1) of the GDPR), the right to data portability (Article 20 of the GDPR) and the right to withdraw consent to personal data processing (Article 7(3) of the GDPR).
The data subject may object to personal data processing with the data controller.
The data subject has the right to file a complaint with the supervisory authority (Article 77 of the GDPR), i.e.:
